On February 28, 2002, the day after the Godhra, the Gulbarg Society was attacked by a Hindu mob. Zakiya, with her husband and Member of the congress Ehsan Jafri, gave her Muslim neighbors protection to save them from the attacking mob. Ehsan left his house to address the mob gathered outside, and asked them to save the lives of those who hid inside. But the mob ignored his requests. And Ehsan Jafri was killed by 69 others by the mob in the Gulbarg Society massacre. Despite numerous help for help, neither the fire brigade nor the police received the scene in good time. “We had the day off,” replied a police officer.
This response from the police officer had serious questions about the role of administration and proposed intentional information from state machines.
Zakiya raised her voice against this injustice; She handed numerous cases in Three different dishes By 2022, when the Supreme Court of Court against STON deployed clean chit against the current prime minister and the Prime Minister of Gujarat, Narendra Modi.
Zakiyas activism
Zakia Jafri submitted and for On June 8, 2006 against 63 people, including Narendra Modi, then cm from Gujarat; his employees; Owner of administrative positions (IAS, IPS, MLAS); And even some post owners of the Ministry of Union under various actions and sections of IPC. The Zakiya Jafari case was not just about the massacre of the Gulbarg Society, but also included around 300 incidents in 19 districts, which included the terrible actions of genocidal violence in Gujar in 2002. This was aimed at both criminal and administrative responsibility and accountability of state missionaries in which the unrest of Gujarat.
This complaint was addressed to PC Pandey, which was then Gujarat’s DGP. says“I ask you to observe the deliberate and deliberate failure of the state government in its way of observing the constitutional government in the state. The public service was paralyzed, as was the police machinery that influenced, manipulated and bullied to sign the murderous melody of the conspirators who wanted to destroy the constitutional government in the state, a government style that guarantees the basic principles of justice. Justice and non -discrimination. “
This complaint submitted on June 8, 2006 was unanswered by the authorities. This lack of answer forced Zakiya to approach the Supreme Court of Gujarat, and registered her complaint as first information report (FIR) so that an examination of a wider conspiracy behind the unrest of Gujarat could be initiated. However, the High Court dismissed her application and instructed it to submit a private complaint. The process of private complaint is complex, so Zakiya Jafri entered the Supreme Court by submitting a special vacation against the rule of November 2, 2007 of the High Court Gujarat. The Supreme Court instructed the establishment of a SEC examination team (SIT) to examine Gujaratrius and claims in Zakiya’s petition.
The Supreme Court appointed the well -known legal expert Prashant Bhushan as Amicus Curiae to support the examination, but was later replaced by Raju Ramchandran.
The SIT submitted its preliminary report on May 12, 2010, followed by a closure report on February 8, 2012. The report on the murder of Ehsan Jafri caused serious concerns. According to SIT data in connection with the call records by EHSAN JAFRI, it was not available. Ironically, the Jafi report also accused Jafi of violence by dismissing a firearm and causing himself to the concept of “measures that reacts with the prime minister’s guidelines”.
In addition, Ms. Jafri’s legal rights were violated during the submission of the closure report. When the report was submitted without giving the opportunity to speak, she has a right that keeps it legally. As a result, she had to submit another special holiday at the Supreme Court, which claimed access to all examination documents, reports and documents. Despite the clear guideline of the court for the SIT to provide these materials, the team delayed compliance, whereby almost a year between the submission of his final report on February 8, 2012 and the order of the court on February 7, 2013 The documents were prescribed.
Zakia Jafri, together with the citizen of justice and peace, led these delays to submit a protest on April 15, 2013. In this Protest application, Zakiya asked:
“When deciding on the Protest applications, the Hon’ble Court must exercise its independent opinion in the final report submitted by the investigative authority. The court is not bound to the conclusions of the investigative authority. The Court must look at the material to fulfill whether it is an appearance whether it is the knowledge of the crime. The material must be examined, not from the angle that it is sufficient for the conviction, but that the material is sufficient in the event. The Court of Justice cannot decide to find out whether a crime is shown or not what the domain is when the process begins and evidence is given by the parties. “
In February 2013, the CJP legal team analyzed 23,000 pages with documents according to a guideline of the Supreme Court, which set up the basis of the protest petition and identified defects in the investigation of the sit and claimed a broader conspiracy. But after 18 hearings, the petition was dismissed on December 26, 2013 when Magistrat Ganatra accepted the SIT report. In 2014 Zakiya moved to Gujarat High Court, but in 2017 the Supreme Court of Gujarat rejected the allegations of a greater conspiracy.
In 2018, Jafri filed a petition of special vacation to the Supreme Court and denied the rejection of her protest application by the magistrate. In addition, she asked the High Court 2017 of the Supreme Court of Gujarat in 2017 when it confirmed the examination of her petition by the magistrate for material reasons. Through this appeal procedure, Jafri requested a further investigation of the conspiracy of 2002.
On June 24, 2022Judge at the Khawilkar, Dinesh Maheshwari and CT Ravikumar gave an anonymous judgment in which he confirmed the clean chit granted by the magistrate and the accused. The bank rejected Ms. Jafris’s petition and came to the conclusion that it hadn’t deserved them.
Despite the relentless, exhausting and biased judicial process, Zakiya Jafari fought not only for her husband, but also for the thousands who were killed, tortured and driven out in the riots of 2002. Therefore, Zakiya Jafari’s identity is not limited to being just Ehsan Jafri’s wife. Together with her, others who are connected to the citizens of justice and peace (CJP), including TEESTA SETALVAD, aimed at the system, submitted and even submitted various police cases against them Teesta was sent to prison for 70 days. You pay for standing against injustice.
After Zakiya’s death, Teesta Setalvad wrote on her X “Zakia Appa, a compassionate leader of the human rights community, 30 minutes ago! Your visionary presence will be missed by D Nation Family Friends & World! “
Her son Tanveer remembered her as“She was satisfied and at peace Ki from Woh Baithi Nahin Rahi, bees Haal Relentless young Laadi (she was satisfied with not leaning back, she fought for 20 years).
“Since the murder of her husband as a victim, she has tirelessly not only for herself, but for all women and others who are the victims of an unjust and violent system,” she fought for justice. “ Father Cedric Prakash, civil rights activist, said.
Zakiya Jafari may not have received any justice, but due to her resistance, she has left us all a permanent legacy – a legacy of standing for the truth, too refusing to arise and to raise the voice against injustice. The coming generations will remember them for this relentless struggle and their courage will continue to inspire us.
